Kris Humphries Seeks Annulment From Kim Kardashian

Nearly a month after Kim Kardashian filed for divorce from Kris Humphries, the NBA star is firing back, seeking an annulment to erase his brief 72-day marriage to the reality star on the grounds of fraud.

Under California law, an annulment will be granted only if the court finds that there was no validity to the marriage. In his Superior Court filing, Humphries checked the boxes marked "nullity of voidable marriage," citing "fraud" as the basis for their split.

If Humphries is denied an annulment, he is seeking legal separation, which means the former couple could avoid all divorce proceedings. Back in October, Humphries released a statement, saying he was committed to working on repairing his short-lived marriage. "I love my wife and am devastated to learn she filed for divorce," he toldPeople magazine at the time. "I'm committed to this marriage and everything this covenant represents and I'm willing to do whatever it takes to make it work."

On October 31, Kardashian filed for divorce, citing "irreconcilable differences." "After careful consideration, I have decided to end my marriage. I hope everyone understands this was not an easy decision," Kardashian said in a statement. "I had hoped this marriage was forever but sometimes things don't work out as planned. We remain friends and wish each other the best."

Court papers released online state that Kardashian requested the court uphold the prenuptial agreement the two signed before the wedding, which guarantees that the reality star will keep all money earned during their marriage.

Kardashian and Humphries married on August 20 in a lavish $10 million affair that was captured by E! cameras and aired in a two-day television special. Their relationship is currently being played out on this season of "Kourtney and Kim Take New York."

The news comes on the same day as Kim's sister, Kourtney Kardashian, revealed that she is pregnant with her second child with boyfriend Scott Disick.

Was Kim Kardashian's 72-day marriage to NBA player Kris Humphries a big sham? Opinions are divided on this raging topic of national debate, but Humphries himself appears to think so.

TMZ reports that, although Kardashian has already filed for divorce from Humphries, the basketball jock has filed for an annulment, claiming that the "Keeping Up With the Kardashians" star defrauded him into marrying her.

Individuals connected to the athlete tell the site that Humphries was unaware that he was allegedly being played for a pawn and hoped that their union would be a lasting relationship of eternal love, but Kardashian wasn't interested.

In the annulment filing, Humphries asks that Kardashian be ordered to pay his attorney's fees. The suit also mentions "community and quasi-community assets."

Makes sense -- what's a quasi-marriage without a quasi-community?

For what it's worth, friends of Kardashian tell TMZ that she wanted the marriage to last -- but hey, 72 days is a long time. People change.

Kardashian also reportedly wanted to file for an annulment rather than divorce initially, but was advised that the couple had no legal grounds for annulment -- which, under California law, include impotency, incest, bigamy, unsound mind, force or fraud.

Since Kardashian filed for divorce in late October, many have speculated that the wedding was merely a ploy for money and/or publicity.

Kardashian has gone on the offensive over such claims on occasion -- earlier this month, the reality queen filed suit against her one-time employee, Jonathan Jaxson, for claiming on a local Los Angeles news show that the marriage was staged.

Meanwhile, we still have nine months to speculate as to whether Kardashian's sister Kourtney will actually give birth to a child, or merely produce a Cabbage Patch Doll marinated in Fake Bake in order to score a few magazine covers.



Kim Kardashian and Kris Humphries to have marriage annulled?

Yesterday, we were hearing how Kris Humphries pals were banging on about how in love with Kim he was. Today, we hear the man wants an annulment – not a divorce – and on the grounds of fraud! Crikey!

The NBA star is said to have agreed to answer Kim’s request for a separation - which she presented him with on 31 October - but divorce isn’t something he’s after – he wants the whole thing completely and utterly nullified. And if he doesn’t get that, he wants a legal separation.

Confused? Yeah, so are we but we’ve given up trying to work out what’s going on there. Instead, we do know that according to US magazine People, Kim originally wanted an annulment too so – shock horror – the pair might be about to agree on something (but fraud, really? Who’s been double-crossing who?).

A blabbermouth Kardashian insider explained, “She always wanted an annulment but attorneys were against it so she's happy that both parties agree now.�

Phew! And here we were worried that this could get ugly(ier). According to Californian state law, the nullification of a marriage can only be granted if a court finds that no valid marriage ever occurred. And despite their protests to the contrary at the time, it appears Kim and Kris could have given in and admitted they don’t see their short time together as a 'valid marriage' either.

Well, we have been saying for a while that a 72-day marriage is a bit suspect – but let’s see if the court agrees!
